SC directs Centre to Initiate process to Fill up Vacancies in ITAT [Read Order]

The Supreme Court directed the central government to initiate process to fill up vacancies in the income Tax Appellate Tribunals within three weeks.

A bench comprising Chief Justice J S Khehar and Justice D Y Chandrachud was considering a petition filed by Mr. Akshay Pundir, who said in his petition that ad hocism has become order of the day as many of the posts of senior vice presidents and vice presidents have not been filled up. Before the Court, it was contended on behalf of the petitioner that “The Selection Committee had made recommendations in 2015, but the appointments were made in 2017. Three of the four persons who were appointed would be retiring soon and the appointments were a mere lip service”.

After perusing the reasons recorded by the Appointment Committee of the Cabinet which were submitted before the Court during the course of hearing, a two judge bench granted three week to the Government on request of the Solicitor General.

By that time, we hope and expect, that the proceedings will be initiated for filling up of the remaining vacancies as well.” The bench said.
