The Ministry of Corporate Affairs (MCA) is planning to accept the submissions of some company forms in the physical format due to the technical issues faced by the users while filing the forms with its MCA21 portal.

The technical issues in the online filing of forms in the Ministry of Corporate Affairs (MCA) portal are not a new subject matter to discuss. However due to the overflow complaints about the portal by the users especially Chartered Accountants made the ministry take such a decision.

Recently, the designated partner of the petitioner Limited Liability Partnership (LLP) approached the High Court of Kerala, citing the inability to file LLP Forms in the MCA Portal.

The decision came after the Kerala High Court issued an interim order in the plea mentioned earlier, ordering the ministry to accept physical applications after its online system had crashed.

Back in January 2021, the MCA portal crashed and the users filled the social media asking for the extension of the Companies Fresh Start Scheme, 2020 (CFSS).

There are still issues with the MCA portal that have not yet been fixed. But until things return to normal, it would be preferable if the ministry accepted the physical forms as soon as possible.

A Chartered Accountant has filed a writ petition before the Kerala High Court, citing multiple technical faults in the Ministry of Corporate Affairs’ (MCA) new V3 platform. Even though the portal’s objective is to expedite the processes by avoiding paper forms and making them digital, it has caused both the ministry and its users a lot of issues.
