Allahabad HC Slams Central Excise Dept for Delay in Court Proceedings [Read Order]

A division bench of the Allahabad High Court, last week criticized the Central excise Department as the department’s act of changing lawyers panel caused delay in Court proceedings.

Justices Bharati Sapru and Saumitra Dayal Singh warned the department to not repeat this situation.

A Revenues’ appeal against M/S Auto Gollon Industries Pvt. Ltd was posted on 27th November. When the matter was called out, Sri Praveen Kumar, Advocate informed the Court that though he is also a panel lawyer but the file of this case has been now allotted to someone else.

 “This situation may not continue any further. A proper distribution of files may be made by the Department, so that the Court’s work may not suffer,” the bench said.

The copy of the order was, then served to Adv. Praveen Kumar and directed him to communicate the same with the department within 24 hours to ensure compliance of this order.
