CBEC Chief asks Officials to File SLPs and Appeals without any Delay [Read Letter]

Vanaja N Sarna, the present chairperson of the Central Board of Excise and Customs (CBEC), recently asked the Officials to avoid delay in filing Special Leave Petitions (SLPs) and appeals before the Courts.

The letter issued by the CBDT Chief on Friday pointed out that the Attorney General of India has expressed concern over the delay in filing of SLPs and Appeals in the Hon’ble Supreme Court which often leads to dismissal at the admission level itself purely on the ground of delay.

“Most of these cases involve large amounts of revenue. In this regard, CBEC has already put in place a mechanism to prevent delay in filing of SLPs and Appeals in the Hon’ble Supreme Court and a letter dated 15tJune 2017 to this effect has already been circulated indicating revised timeframes. This is also available in the CBEC website. May I request you all to strictly adhere to the time frame indicated in the letter so as to avoid any delay in filing of SLPs and Appeals,” she said.

In a bid to reduce litigations, the CBEC issued a circular on the subject “Orders of Supreme Court, High Courts and CESTAT accepted by the Department and on which no review petitions, SLPs have been filed”, in relation to Indirect Taxes.
