Hike in Monetary Limit for Tax Appeals: Dept to file Single Application in High Courts and CESTAT [Read Circular]

As the Government has raised the threshold limit for tax appeals to reduce litigation, the Central Board of Indirect Taxes and Customs (CBIC) has directed its officials to file a single application before the High Courts and CESTAT to complete the process in a speedy manner.

“As you are already aware a consolidated list of cases ripe for withdrawal from the Supreme Court has already been compiled. This has been sent to the CAS for the requisite drafting of interlocutory application/filing of the single application on the advice of the Ld AG. The idea behind this is to ensure that the withdrawal takes place in a single move. It is evident that valuable time would be saved, as the filing of many separate applications would not be required,” the Board said in a recent circular.

The Board earlier directed the officials to complete all the works related to withdrawal of the appeal by 30th September 2018.

“Since there is a deadline for completion of the entire exercise, the Zones may adopt a similar action for filing single consolidated withdrawal application, in respect of all identified cases, pending in the High Courts and CESTAT under your charge,” the Board said.

It was also directed that after completion of the withdrawals a consolidated report may please be sent to the Board by 01.10.18 so that the position could be put up further for perusal.
