Supreme Court clarifies Retirement Age of ITAT President & Members [Read Order]

The Supreme Court on Monday clarified that the retirement age of the person appointed as the President will continue till the age of 65 years and the persons selected as the Members will continue till the age of 62 years.

A bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud, while hearing a petition by Kudrat Sandhu said that “we may note that there is some confusion with regard to the Income Tax Appellate Tribunal (ITAT) as regards the age of superannuation. We make it clear that the person selected as Member of the ITAT will continue till the age of 62 years and the person holding the post of President, shall continue till the age of 65 years.”

Before the Court, Attorney General KK Venugopal submitted that there is no stipulation of tenure in respect of the ITAT.
