A two-judge bench of Justice B V Nagarathna and Justice Ujjal Bhuyan observed that there is a gross delay of 325 days in filing the Special Leave Petition. Moreover, the issues that arise in the case are covered by the judgment of the Court in Engineering Analysis Centre of Excellence Pvt. Ltd. v. Commissioner of Income Tax (2022).
The Court dismissed the Special Leave Petition both on the grounds of delay as well as on merits.
