AA and EPCG Holders eligible for the Amnesty Scheme for OTS of Default in Export Obligation: DGFT issues Procedure [Read Circular]

The Directorate General of Foreign Trade (DGFT) has issued procedures on application for filing an amnesty scheme for One Time Settlement of Default in Export Obligation by Advance Authorisation (AA) holders and Export Promotion Capital Goods (EPCG) holders on April 17, 2023.

The DGFT is in charge of developing and carrying out export and import policies and processes, granting licences to exporters and importers, and monitoring laws and regulations pertaining to international commerce.

The agency also serves as a point of contact between the Indian government and international trade associations and offers advice and support to importers and exporters in India.

The Regional Authorities (RA) is directed to process the application within the 3 working days.

As per the public notice issued on April 1st, 2023, the procedures specified as follows:

  1. Log into DGFT Website and navigate to Services — Advance Authorisation/DFIA > Closure of Advance Authorisation.

For EPCG, navigate to Services — EPCG > Closure of EPCG

  • Select Checkbox ‘Amnesty scheme for one-time settlement of default in export obligation’. Then, proceed with the application
  • Calculation of the duty and interest values to be paid under the ‘Redemption Matrix’ tab by the applicant. Submit the application.
  • On receipt of online application, the RA concerned shall examine and confirm the shortfall through an online letter.
  • Payment of duty and interest to the Jurisdictional Customs Authority and provide the proof of payment in response to the said letter online.
  • Concerned RA may review and consider issuing an Export Obligation Discharge Certificate (EODC) online based on the proof of payments and other required documents.

  • Call the Toll-free DGFT Helpdesk numbers.

Recently, the DGFT also issued a notice with respect to Export Obligation Discharge Certification (EODC) for AA and EPCG.
