AA Holders can apply for Review of Norm's Committee Decisions taken Pre-April 1st, 2023 until Dec 31, 2024: DGFT [Read Circular]
The directorate also clarified that, in other cases, the timeline defined under Para 4.17 of HBP 2023 will prevail

The Directorate General of Foreign Trade ( DGFT ) has issued Policy Circular No. 03/2024, dated May 30, 2024, to clarify the deadlines for filing review applications concerning Norms Committee decisions. It was clarified that the AA holders can apply for the Review of committee’s norms decisions taken pre-April 1st, 2023 until 31st December 2024.
Under Para 4.17 of the Handbook of Procedures ( HBP )-2023, applicants are permitted to file a representation for a review of the Norms Committee's decisions regarding the fixation of norms within a period of 12 months from the date the decision is uploaded on the DGFT website.
Despite this provision, the Directorate had received several representations and grievances from AA holders who encountered difficulties adhering to the stipulated timeline for filing reviews under Para 4.17 of HBP-2023.
The DGFT’s circular stated as follows:
“Hence, it is clarified that, in the interest of export promotion and to promote ease of doing business, in all cases where Norm's Committee decision were taken before 01.04.2023, the AA holder, who wishes for a review, may file their review application till 31.12.2024. No such review will be entertained beyond this date.”
The directorate also clarified that, in other cases, the timeline defined under Para 4.17 of HBP 2023 will prevail.
An addendum was issued by the DGFT on 31st May 2024 in which it was clarified that “In reference to Policy Circular No. 03/2024 dated 30.052024, it is informed that such review will be applicable only for cases where Advance Authorisation was issued on or after 01.04.2019 and no review decision had already been taken by the NC”
