The Kerala High Court dismissed the review petition by upholding the Interim order which lifts the attachment on the ICICI Bank Account of the petitioner. On appellate tribunal made an order of attachment on the bank account to recover Excise Duty.

Mithlaj P, the review petitioner was represented by Sri Anil Sivaraman, Smt Raji Vincent and Jsmt Othisha K A. The respondent department was represented by Sri Sreelal N Warrier, Sri Sreejith P  R, Sri Lal K Joseph, Sri T A Luxy, Sri P Muraleedharan, Sri Suresh Sukumar, Sri Anzil Salim and Sri Sanjay Sellen.

Considering note of the statement furnished by the respondents giving details of the amounts credited in the various bank accounts of the petitioner, the division bench comprising Dr Justice A K Jayasankaran Nambiar & Dr Justice Kauser Edappagath held that “our earlier order directing the lifting of the attachment on the ICICI  Bank, Adimali Branch, consequent to the payment of Rs.25,00,000/- from the said account to the account of the respondents 1 to 3, would suffice to address the present grievance of the review petitioner.”

The court closed the Review Petition by making the interim order dated 05.02.2024 absolute.
