The Central Bureau of Investigation ( CBI ) has taken charge of an Investigation pertaining to allegations of bribery levelled against the Deputy Commissioner and Superintendent of the Central Goods and Services Tax Department.

A complaint was received by the Lokpal of India alleging that two Officers of the GST Department had indulged in accepting bribes in aberrance of their statutory duties and responsibilities as Governmental Officers.

The Lokpal of India, through an Order dated 22.07.2024 directed the CBI to take over the Investigation in the instant matter to conduct inquiry on the purported Offences.

The Lokpal of India, is an Independent authority established to uphold administrative accountability of the Government and Governmental Bodies to the Republic of India. The Lokpal has been established as per the provisions of The Lokpal and Lokayuktas Act, 2013 and exercises powers to issue directions to CBI.

A First Information Report (FIR) was filed by the CBI on 22.08.2024 under Section 173 of the Code of Criminal Procedure, 1973 underlining the Offences reported against the now-discharged GST Officers.

The Charges have been have been framed by the CBI citing Section 7 (Offence relating to public servant being bribed), Section 12 (Abetment), 13(2) (Criminal misconduct by a public servant) r/w 13(1)(a) (Criminal Conspiracy and Criminal Breach of Trust) of the Prevention of Corruption Act, 1988 in conjunction with Section 120-B (Punishment of Criminal Conspiracy) read with Section 409 (Criminal Breach of Trust by Public Servant).

The identities of the Complainant and the Public Servants subject to inquiry have been kept confidential until the conclusion of the Investigation according to Rule 4(a) of the Lokpal Complaint Rules, 2020.

In light of the directives issued by the Lokpal of India, CBI has registered a case under the aforementioned sections against the supposedly delinquent GST Officers and assigned Sh. Vipin Kumar Gupta, PI, CBI, AC-III to lead the investigation.
