CBIC further extends Period to Pass Order for Refund of Unutilised ITC till Aug 30, 2020 [Read Notification]

The Central Board of Indirect Taxes and Customs (CBIC) on Saturday notified the further extension of the period to pass orders relating to refund of unutilized Input Tax Credit (ITC) under Section 54(7) of CGST Act, till August 30, 2020.

The Board seeks to amend Notification No.46/2020-Central Tax, dated  June 9, 2020, which sought to extend the period to pass an order under Section 54(7) of the CGST Act, the period from March 20, 2020, to June 29, 2020, was extended till June 30, 2020.

The board amended the first paragraph of Notification No.46/2020-Central Tax, dated  June 9, 2020, which says, “in view of the spread of pandemic COVID-19 across many countries of the world including India, the Government, on the recommendations of the Council, hereby notifies that in cases where a notice has been issued for rejection of refund claim, in full or in part and where the time limit for issuance of an order in terms of the provisions of sub-section (5), read with sub-section (7) of section 54 of the said Act falls during the period from the 20th day of March 2020 to the 29th day of June 2020, in such cases the time limit for issuance of the said order shall be extended to fifteen days after the receipt of the reply to the notice from the registered person or the 30thday of June 2020, whichever is later.”

In the said notification, in the first paragraph, for the words, figures and letters “29th day of June 2020”, the words, figures and letters “30th day of August 2020” shall be substituted; and for the words, figures and letters “30th day of June 2020”, the words, figures and letters “31st day of August 2020” shall be substituted.
