The Central Board of Indirect Taxes and Customs (CBIC) issued Notification No. 02/2025-Central Tax (Rate) announcing Goods and Service Tax (GST) Exemption on Gene Therapy. These amendments are based on recommendations from the 55th GST Council meeting, effective immediately.

1. Inclusion of Gene Therapy in Tax Exemption Schedule:

The Schedule of the principal notification now includes a new entry, S. No. 105A, 30, explicitly exempting gene therapy from GST. This change is expected to make these treatments more accessible and affordable for patients across the country.

2. Revised Definition of Pre-Packaged and Labelled Goods

The notification also updates the definition of "pre-packaged and labelled" goods to include all retail commodities of up to 25 kilograms or 25 liters. This clarification references Section 2(l) of the Legal Metrology Act, 2009, ensuring compliance with specific labelling and declaration rules. The change targets enhanced transparency and regulatory adherence in the sale of pre-packed goods.

The amendments come into force with immediate effect

The amendments build on the principal notification No. 2/2017-Central Tax (Rate), originally published on June 28, 2017, and last amended on July 12, 2024. This move by the GST Council is part of an ongoing effort to simplify tax structures and promote equitable economic growth.
