The Central Board of Indirect Taxes and Customs (CBIC) has issued a corrigendum to the Customs Anti Dumping Duty Notification No. 12/2023-Customs (ADD), Dated 21st November, 2023.
The notification contained the following HSN Codes to be considered for anti-dumping duty: –
28429090, 28269000, 28399090 and 28421000 of Synthetic Grade Zeolite 4A (Detergent Grade)
The Current notification omitted the codes 3824 99 22, 3824 90 90 and 3824 99 90.
In Conclusion of the findings of DGFT —
(i) that there is continued dumping of the subject goods from the subject country and the imports are likely to enter the Indian market at dumped prices in the event of cessation of duty;
(ii) dumped imports from subject country are causing injury to the domestic industry;
(iii) the information on record shows likelihood of continuation of dumping and injury in case the antidumping duty in force is allowed to cease at this stage;
(iv) there is strong likelihood of diversion of exports of the subject goods from the subject country to India if the existing anti-dumping measure ceases to exist were noted by the Central Board of Indirect Taxes and Customs (CBIC) and CBIC recommended the continued imposition of the anti-dumping duty on imports of the subject goods, Synthetic Grade Zeolite Grade 4A (Detergent Grade) originating in or exported from the subject country – China PR, in order to remove injury to the domestic industry.
The anti-dumping duty imposed under the notification was to be levied for a period of five years (unless revoked, superseded or amended earlier) from the date of publication of this notification in the Official Gazette and shall be payable in Indian currency.
Notably, in accordance with the investigation report from the Directorate General of Foreign Trade (DGFT), the Central Board of Indirect Taxes and Customs (CBIC) has also issued a Gazette Notification to impose Anti-Dumping Duty on imports of Zeolite from Iran and Thailand.
