The Central Government has notified the constitution of the Principal Bench of the Goods and Services Tax Appellate Tribunal (GSTAT), by notification in the official gazette.

In a significant development, the Central Government, in exercise of its powers under section 109(3) of the Central Goods and Services Tax Act, 2017 (12 of 2017), has announced the establishment of the Principal Bench of the Goods and Services Tax Appellate Tribunal (GSTAT) in New Delhi.

This decision, published in the official Gazette on 1st January, 2024, comes into effect immediately.

The move supersedes the earlier notification (S.O.1359(E)) issued by the Ministry of Finance, Department of Revenue, dated March 13, 2019, as published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii). The newly constituted GSTAT Principal Bench is set to begin operations, with effect from the date of this notification.

After the introduction of GST, the GSTAT had not yet been established. There was a lot of pressure on the central government from all directions. Lots of cases were still waiting in High Courts after the GST was implemented since there is not an appropriate appellate tribunal to handle the problems.

Despite the fact that GST has an AAR, it only addresses minor problems like tax rates; it does not address the more significant ones. Additionally, the AAR’s application under GST is restricted, as are its judgements.
