CBIC Constitutes Panel of Senior/ Junior Standing Counsels for handling Litigations [Read Circular]

The Central Board of Indirect Taxes and Customs (CBIC) constituted a panel of regular panel of Senior/ Junior Standing Counsels for handling cases of CBIC before the various High Courts and other Forums.

“In order to recommend additional Senior/Junior Standing Counsels for handling cases of indirect taxation pertaining to CBIC, applications are invited for constituting panel for Junior/Senior Counsels for representing the Central Board of Indirect Taxes and Customs and its field formations and attached offices, in the Hon’ble High Court of Delhi and other Appellate for a,” the Board said.

An instruction passed earlier in 2012 intended to amend the past instructions where the Board has revised the fee for appearance in statutory appeals and writ petitions, retainership etc.

For written opinion, the instruction stated that no fee is payable on opinion given advising for filing of further appeal in the case defended by the counsel that is decided against the department.

The fee payable for effective hearing Rs.6,000/– per day. For non-effective hearing Rs.1,000/- ((subject to maximum of 5 non-effective hearing Rs.2,000/ per case. For main case/first such drafting in a issue – Rs.2,0001- per case. For similar affidavit in common/ connected matters -Rs.1,000/- per case. Rs.2,000/- for each application Rs.1200/- per case.

The instruction also prescribed that the Standing Counsels and Junior Standing Counsels shall be entitled to only 1/3rd of the amount specified against each item of work. The Junior Standing Counsel shall not be entitled to retainership fee.
