CCI invites Applications from Advocates and Law Firms to Represent Commission and Director General before Courts and Tribunals

The Competition Commission of India ( CCI ) invited the applications from advocates and law firms for empanelment to represent the CCI and Director General before various courts and tribunals. The qualified advocate or law firm can apply for the same.

Eligibility for Empanelment

  1. The Advocates should be familiar with various branches of law especially those concerning competition law, constitutional /service law, labour law, contract law, commercial law, property laws and taxation etc.
  2. In addition to above, the Advocates are required to have the minimum professional/court practice experience as under:
  • For empanelment for the Supreme Court of India .…10 yrs. experience in the Supreme Court.
  • For empanelment for the High Court in India/COMPAT … .7 yrs. experience in the High Court.
  • For empanelment for the Subordinate Courts/Tribunals ….5 yrs. experience in Subordinate Courts/Tribunals.

Provided that the Competent Authority may relax the above conditions at its discretion, if otherwise found suitable in certain cases

  1. For considering empanelment for the Supreme Court, generally those Advocates who are regularly practising including Advocates-on-Record of the Supreme Court would be considered, if they are otherwise found to be competent and suitable.

Tenure/term of Empanelment

The initial empanelment will be for three years or until further orders whichever is earlier. Performance of empanelled advocates shall be reviewed on an annual basis. However, on completion of the term and satisfactory performance of the advocate, the empanelment may be renewed for a period of another three years by the Commission. The Commission reserved the right to terminate the empanelment of any advocate at any time.

Documents to be obtained from the Advocate

The Advocates will be required to furnish their Bio-data as per the format given in Annexure A. The attested copies of the following documents required to be submitted with application:

  1. High School certificate in support of age
  2. Registration with Bar Council
  3. Identity card issued by Bar Association / Bar Council
  4. Copies of empanelment with other Organisations
  5. Certificates in support of educational qualifications
  6. An undertaking from the advocate to the effect that all information furnished by him is correct.

Right to Private Practice and Restrictions

  1. An advocate shall have the right to private practice which should not, however, interfere with or be in conflict with the efficient discharge of his duties as an empanelled advocate of the Commission.
  2. An advocate shall not advise any party or accept any case against the Commission in which he has appeared or is likely to be called upon to appear or advice.

Applications for empanelment can be submitted from 01.05.2024 until 31.05.2024, by 05:30 PM. The submission of applications must be done through the provided link: https://cci.gov.in/advocate/form.

Important Notes:

  1. Existing empanelled advocates/firms are required to reapply in response to this notice, as a new list of empanelled advocates/firms will be compiled.
  2. Advocates who have previously submitted their applications/CVs to the Commission for empanelment are also requested to apply afresh, following the requisite format as per the provided guidelines.
  3. The link for submitting applications will become active on 01.05.2024.
