The Directorate General of Foreign Trade (DGFT) vide notification no. 39/2023 issued on 24th October 2023 has prohibited the import of Human Embryos and Gametes.
Under the authority vested in it by Section 3 and Section 5 of the Foreign Trade (Development & Regulation) Act, 1992, in conjunction with the provisions outlined in paragraph 1.02 and 2.01 of the Foreign Trade Policy 2023, which may be subject to periodic amendments, the Central Government hereby revises the policy conditions for the item specified in Chapter 05 of ITC (HS), 2022, Schedule –I (Import Policy) as detailed below:

Effect of the Notification: Import of Human Embryo and Human Gametes under ITC(HS) 0511 99 99 is ‘Prohibited’ in accordance with the ART(Regulation) Act, 2021 and The Surrogacy(Regulation) Act, 2021.
