Citing various technical errors on the new V3 portal of the Ministry of Corporate Affairs (MCA), a Chartered Accountant has approached the Kerala High Court through a writ petition.

The petitioner, a Chartered Accountant approached the Kerala High Court citing glitches on the new V3 portal launched by the Ministry of Cor. The whole objective of the new portal was to make the MCA portal more common-friendly. The portal had a number of celebrated features.

The petitioner contended that he was unable to complete the statutory compliances due to the errors on the new portal and the filing of statutory forms through the same is a “time-consuming” process.

One of the significant errors pointed out by the petitioner was that the portal does not have the facility to save half-done data and therefore, whenever, the internet is disconnected during the process, the user has to go through the whole process again, which makes the filing process a time-consuming task.

The errors also include numerical errors in auto-populated figures, attachments of particular statutory forms which were filed online become attachments of different forms when downloaded, etc.

The petition alleges that the Ministry failed to provide an error-free and user-friendly portal for undertaking the statutory compliances by the LLPs and the professionals like Chartered Accountants and Company Secretaries when the MCA is strictly following the deadlines for compliance. Moreover, delayed compliances attract penalties, additional fees,s, etc.

The petitioner, therefore, requested the Court to direct the MCA to take care of the glitches on the portal. The petitioner also pleaded with the Court to direct MCA to waive off the additional fee as the delay was beyond the control of the stakeholders and to refund the additional fee paid so far in such cases. The petitioner also urged that the Ministry shall not release new forms on the V3 portal until the current glitches are resolved.
