Customs Dept allows Manual OOC for Clearance of import consignments where duty not being reflected in ICES after payment

The Customs department, through the Public Notice No.29/2023 allowed manual Out of Charge (OOC) for clearance of import consignments where duty is not being reflected in ICES after payment -reg.
With the notification of the Customs (Electronic Cash Ledger)Regulations, 2022 (ECLR) vide Notification No. 20/2022-Customs (NT) dated 30.03.2022, the statutory provisions of Section 51 A of the Customs Act, 1962)has come into force with effect from 01.06.2022.
However, all the deposit classes were exempted till 31.03.2023, vide Notification No. 47/2022-Customs (NT) dated 31.05.2022, as amended. Further, vide Circular No.09/2023-Cus dated 30.03.2023, the Board has enabled ECL in phases from 01.01.2023.
On enabling the said provisions, in some instances, grievances from trade have been received that after payment of the duty the same is not being reflected in ICES and Out, of Charge (OOC) is not getting effected by the ICES.
It was notified that till the process of integration of ECL with ICES, ICEGATE and Banks becomes smooth and to maintain the uninterrupted flow of the supply chain, it has been decided to allow manual Out of Charge (DOC) to the import consignments of the following categories of importers on the production of a certificate from the Bank as per Annexure-A, indicating the payment of duty, along with an undertaking that in case duty is not credited to the government account the concerned importer shall deposit the same along with applicable interest, immediately:
A. Importers of Perishable Cargo
B. Importers of Pharmaceutical items which move in the Cold Chain.
C. Importers of Liquid Bulk Cargo
D. AFO Clients
E. DPD Clients
F. Manufacturers G. Govt. Departments/P3Us
H. Status Holders under Foreign Trade Policy.
The New notification was issued after considering the need for trade facilitation during the current situation and in the spirit of the Order No. 01/2013-Customs (N.T.) dated 06- 04-2023 issued by the Central Board of Indirect Taxes and Customs, the Custodians and Shipping Lines are requested to waive the demurrage and detention charges till 10.04.2023.
