The Central Board of Indirect Taxes and Customs ( CBIC ) has amended the notification imposing countervailing duty on imports of Copper Tube sin order to resolve the issues regarding change in the name of the producer.
The imports of “Copper Tubes and Pipes” falling under tariff items 7411 10 00, 7411 21 00, 7411 22 00, and 7411 29 00 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the Customs Tariff Act), originating in or exported from Malaysia, Thailand and Vietnam and imported into India, the designated authority in its final findings, vide notification dated the 31st January, 2022 has recommended the imposition of countervailing duty on imports of the subject goods originating in, or exported, from the subject countries.
A notification issued on Wednesday stated that “And whereas, the designated authority, vide amendment notification No. 04/10/2020- DGTR, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 18th November, 2022, concluded that the request of KMCT (Thailand) Co., LTD. for changing name falls within the category of name change only and there is no change in the ownership in a manner that alters the basic nature of the business and recommended that the name of the producer viz. “M/s Kobelco and Materials Copper Tubes (Thailand) Co Ltd.” be amended to “KMCT (THAILAND) CO., LTD” in its final findings notification No. 04/10/2020- DGTR, dated the 31st January 2022.”
The CBIC, therefore, has amended the notification. “In the said notification, in the Table, against serial number 4, in Column (6), for the entry, the following entry shall be substituted, namely: – “KMCT (THAILAND) CO., LTD,” it said.
