DGFT amends Handbook Procedures – Additional Chemicals in Appendix 10(N) – Specific Countries under GAEC – TAXSCAN
The Directorate General of Foreign Trade (DGFT) has amended the paragraph 10.16 (A) of the Handbook Procedures 2023 to amend the procedures for the General Authorisation for Export of Chemicals and related Equipments (GAEC).
The DGFT, vide Public Notice 15/2023 dated 19th June 2023 has amended the Handbook procedures to include the additional chemicals in Appendix 10(N) to the specific countries mentioned in the same appendix under GAEC.
In accordance with the authority granted by Sections 1.03 and 2.0 I of the Foreign Trade Policy (FTP) 2023, the DGFT has amended paragraph 10.16(A) of the Handbook of Procedures (HBP) 2023, with immediate effect.
According to the amendment, the applicant exporter who exports/re-exports the chemicals mentioned in Appendix 10(N) to the specified countries mentioned in the same appendix shall submit an application for GAEC through online SCOMET portal and attach information in proforma - ANF-10A.
Further, as per the amendment in 10.16 A.(II) b.(ii) “The applicant exporter declares that the items that are intended to be exported shall not be used for any purpose other than the purpose(s) stated in the EUC and that such use shall not be changed nor the items modified or replicated without the prior consent of the Government of India. Further transfer/export/re-export under GAEC to the list of applicable countries specified in the Appendix 10(N) will be for civilian end use only;”
The DGFT amendment also added a new entry as Para 10.16.A.(II)c.(iv) as “Any subsequent transfer/export/re-export under GAEC to the list of applicable countries specified in the Appendix 10(N) is only for civilian end use.”
Also, two new entries as Para 10.16.A.(II)d and 10.16.A.(II)e are added as:
Para 10.16.A.(II)d: The exporter must submit a declaration on letterhead that is properly signed and stamped which states that the export is solely being done for civilian end use.
Para 10.16.A.(II)e: A declaration from the Indian exporter stating that the transfers/exports/re-exports in the entire supply chain would be only for the eligible list of countries as provided in Appendix 10(N).
