The DGFT ( Directorate General of Foreign Trade ) has imposed Countervailing Duty ( CVD ) on imports of Atrazine Technical Originating in or exported from China PR, officially notified by the Ministry of Commerce and Industry.
Meghmani Industries Limited ( MIL ) filed an application before the Designated Authority on behalf of the domestic industry for a sunset review investigation to continue and enhance the anti-subsidy duty on imports of Atrazine Technical from China.
The investigation was initiated on August 27, 2018, and concluded that the Chinese subsidies caused injury to the domestic industry. Consequently, countervailing duties were imposed on September 17, 2019.
As per Section 9(6) of the Customs Tariff Act, 1975, and Rule 24(3) of the Customs Tariff Rules, 1995, these duties expire after five years unless reviewed. MIL requested a sunset review, citing the likelihood of continued subsidised imports and injury to the domestic industry.
The Authority found prima facie evidence supporting the need for the review and, on December 29, 2023, initiated the investigation to assess the necessity of continuing the anti-subsidy duty on Atrazine Technical from China.
The Authority concluded that, after a thorough investigation and adequate opportunity for all parties to provide information, the continuation and revision of existing anti-subsidy duties is necessary.
Therefore, it recommended the imposition of a definitive countervailing duty, on all imports of the subject goods from China PR for a period of five years, effective from the date of notification by the Central Government. The data in the column 7 given below in the image is the duty amount imposed.
