The Directorate General of Foreign Trade (DGFT) has notified the initiation of the anti-dumping investigation on imports of “Pentaerythritol” originating in or exported from China PR, Saudi Arabia, and Taiwan on 13th May 2023. The principles as given in Rule 6 of the Anti dumping Rules, 1995 will be followed for the investigation.
In accordance with the Customs Tariff Act, 1975 (CTA) and the Anti-dumping Rules, M/s. Kanoria Chemicals & Industries Limited (applicant) has submitted a request for initiation of an anti-dumping investigation and imposition of anti-dumping duty on imports of “Pentaerythritol, originating in or exported from China PR, Russia, Saudi Arabia, and Taiwan."
According to the applicant, there was no distinction between the goods created by the domestic industry and those exported from the concerned nations. In terms of chemical and physical characteristics, manufacturing procedures and technology, functions and uses, product specifications, pricing, distribution and marketing, and tariff classification of the subject goods, the articles produced by the applicant and imported from the subject countries are comparable.
China, Russia, Saudi Arabia, and Taiwan have been suggested as the subject nations by the applicant. The Data from the Directorate General of Commercial Intelligence & Statistics revealed that the volume of imports from Russia during the investigation was insignificant. Therefore, for the purposes of this investigation, the Authority has designated China, Saudi Arabia, and Taiwan as the relevant countries.
The applicant stated that the market share of subject countries has increased whereas that of the domestic industry and other countries have declined.
Regarding the alleged dumping's basis, the Directorate General of Commercial Intelligence & Statistics advised that the CIF price stated for imports into India was taken into account while determining the export price. Ocean freight, ship insurance, handling fees, port expenses, and bank fees have all been claimed as adjustments. There is sufficient prima facie evidence with regard to the net export prices claimed by the applicant.
Additionally, it was observed that when the normal value and export price were compared at the ex-factory level, it was evident that the dumping margin was not only higher than the de minimis level but also significant.
Furthermore, the investigation's quarterly analysis revealed a reduction in the dumping margin between the first and last quarters. The subject products from the subject countries are being dumped into the Indian market by the exporters from the subject countries, according to adequate prima facie evidence.
After taking into account the applicant's assertions, the Authority decided to conduct the present probe over the course of nine months, from July 1, 2022, to March 31, 2023. However, the final findings were yet to come.
