The Directorate General of Foreign Trade ( DGFT ) has issued Public Notice number 53/2023 dated 27th March 2024, outlining the procedure for obtaining export authorization for information security-related items categorized under SCOMET category 8A5 Part 2.
Under the powers vested by Paragraph 1.03 and 2.01 of the Foreign Trade Policy ( FTP ) 2023, DGFT has introduced an amendment to Chapter 10 of the Handbook of Procedures ( HBP ) 2023.
Para 10.15(11) now provides for General Authorization for Export of Information Security items under SCOMET Category 8A5 Part 2. This allows for the export and/or re-export of indigenous SCOMET items without requiring individual SCOMET authorization, subject to certain conditions.
Applicants must submit a one-time license application under GAEIS through the online SCOMET portal, providing detailed information as specified. The application will undergo scrutiny by the Inter-Ministerial Working Group ( IMWG ), considering factors such as item description, end-user certificates, and compliance programs.
Post-reporting obligations include quarterly submission of post-shipment details for three years, with failure to comply potentially resulting in penalties or suspension/revocation of GAEIS.
Exporters must maintain records of all export documents for five years from the date of GAEIS issuance. GAEIS validity extends for three years from the date of issue, subject to quarterly post-reporting.
