DGFT releases Final Finding of Anti-dumping investigation of imports of "Dispersion Unshifted Single-mode Optical Fiber" from China, Indonesia and Korea RP

The Directorate General of Foreign Trade (DGFT) released the final finding of the Anti-dumping investigation concerning imports of "Dispersion Unshifted Single-mode Optical Fiber" (SMOF") originating in or exported from China, Indonesia and Korea RP.

In accordance with the Customs Tariff Act of 1975 (CTA) and the Anti-dumping Rules, M/s Birla Furukawa Fibre Optics Private Limited (applicant) has submitted a request for the opening of an anti-dumping investigation regarding imports of "Dispersion Un-shifted Single - Mode Optical Fibre" from China PR, Indonesia, and Korea RP (subject countries) before the Designated Authority ("Authority").

Recommendations of the Authority:

The Authority noted that the investigation was initiated and notified to all interested parties and adequate opportunity was provided to the domestic industry, other domestic producers, Embassies of the subject countries, producers/exporters of the subject goods from the subject countries, importers, users, and other interested parties to provide information with regards to dumping, injury, and causal link.

Additionally, it recommended the imposition of anti-dumping duties on the subject imports from the subject countries, specifically China, Indonesia, and Korea, after initiating under Rule 5(3) of the AD Rules, 1995, conducted an investigation in accordance with Rule 6 of the Anti-Dumping Rules, 1995 regarding dumping, injury, and causal link as required under Rule 17(1)(a) of the AD Rules, 1994, and established material injury to the domestic industry as a result of the subject imports from the subject countries.

Further, having regard to the lesser duty rule as enunciated in Rule 17 (1)(b) of the Anti Dumping Rules, 1995, the Authority recommended the imposition of definitive anti – dumping duties equal to the lesser of margin of dumping or margin of injury, from the date of notification to be issued in this regard by the Central Government, so as to remove the injury to the domestic industry. Accordingly, definitive anti – dumping duties equal to the amount indicated in Column (7) of the ‘duty table’ recommended to be imposed on all subject imports from the subject countries originating or exported from the subject countries.

An appeal against the recommendation of the Authority shall lie before the Customs, Excise and Service Tax Appellate Tribunal.
