The Directorate General of Foreign Trade (DGFT) vide Case No. CVD-NSR-01/2022 has terminated the New Shipper Review Investigation (NSR) on Copper Tubes & Pipes Imports from Vietnam. The terminated notification was published on 30th September 2023.

The applicant, LS Metal Vina LLC vide email dated 22.09.2023, has withdrawn their application stating that there is a lacuna under the Indian Countervailing Duty framework in the sense that there are no provisions for a new shipper review, due to which it would not be possible to proceed further in the subject investigation.

The applicant has requested the Authority to terminate the present investigation with liberty to the applicant to file a new application after the amendment to include a NSR provision in the Indian CVD framework.

In view of the request made by the applicant withdrawing its application, the Designated Authority considered that the investigation has become infructuous after the withdrawal of the application.

As the applicant has withdrawn their application, it is deemed appropriate to discontinue the ongoing investigation. Therefore, in accordance with Rule 14(a) of the Rules, the Authority closed the New Shipper Review investigation for determining the individual countervailing/anti-subsidy duty rate for M/s LS Metal Vina LLC, a producer from Vietnam, in the matter of anti-subsidy duties imposed on the import of Copper Tubes & Pipes originating in or exported from Vietnam. This investigation was originally initiated via notification no. 07/16/2022-DGTR dated September 30, 2022.
