ED Filed Prosecution Complaint under - PMLA - Special Court Convicted Mahabir Singh - TAXSCAN

The Special Court, PMLA, Jalandhar has convicted Mahabir Singh S/o Nirvair Singh under the Prevention of Money Laundering Act, 2002 for committing the offence of Money Laundering as defined under section 3 of the Prevention of Money Laundering Act, 2002(PMLA).

The PMLA Special Court has found Mahabir Singh guilty and sentenced him to 4 years of rigorous imprisonment and a fine of Rupees Twenty Thousand.

The immovable properties which were earlier attached by the ED have been confiscated u/s 8(5) of the Prevention of Money Laundering Act, 2002. ED initiated an investigation in the year 2009 on the based of an FIR registered under various sections of the NDPS Act, 1985 and Arms Act, 1959. Thereby accused Mahabir Singh was earlier convicted by Hon’ble Special Court, Amritsar in the scheduled offence u/s 21 of Narcotic-Drugs and Psychotropic Substances Act 1985 (NDPS Act) 1985, about the recovery of 15 kg of Heroin. 

The investigation conducted by the ED revealed that the Proceeds of crime generated from the drug trade were invested by the accused in immovable properties which were subsequently attached by the ED.

The Conviction of the accused by the Special Court was based on the Prosecution Complaint filed by the ED in the year 2017 under the provisions of the Prevention of Money Laundering Act, 2002.
