The Ministry of Finance issued Notification No. 18/2025 dated March 6, 2025, granting income tax exemption to the Delhi Building and Other Construction Workers Welfare Board under Section 10(46) of the Income-tax Act, 1961. The exemption applies to specific sources of income generated by the Board, which is established by the Government of the National Capital Territory ( NCT ) of Delhi for the welfare of construction workers.

Scope of Exemption

According to the notification, the following types of income earned by the Board shall be exempt from income tax:

  1. Cess received
  2. Registration and renewal fees collected from construction workers
  3. Interest earned on bank deposits.

Conditions for Exemption

The exemption is subject to the following conditions:

  • The Board must not engage in any commercial activity.
  • The nature of the activities and income must remain unchanged throughout the financial years covered.
  • The Board must file income tax returns as per the provisions of Section 139(4C)(g) of the Income-tax Act, 1961.

Retrospective Application

The notification also states that this tax exemption will apply retrospectively for the financial years 2011-12, 2012-13, and 2013-14, covering the assessment years 2012-13, 2013-14, and 2014-15.

The Delhi Building and Other Construction Workers Welfare Board primarily works to provide social security and financial assistance to laborers engaged in construction work across the capital.
