On September 15, 2023, the Government of India, through order number 326/2023, directed the termination of Sanjay Kumar Mishra’s tenure as the Director of Enforcement in the Enforcement Directorate. Additionally, the government has designated Rahul Navin, IRS, who holds the position of Special Director in the Enforcement Directorate, as the interim Director of Enforcement until the appointment of a permanent Director or until further notice, whichever comes first.
The order states that “The President is pleased to order thc cessation of tenure of Shri Sanjay Kumar Mishra, IRS(IT: 1984) as Director of Enforcement in the Enforcement Directorate on 15.09-2023 and placing Shri Rahul Navin, IRS(IT: 199.3), Special Director, Enforcement Directorate as in-charge Director, Enforcement Directorate till appointment of a regular Director or until further orders, whichever is earlier.”
The Central government had approached the Supreme Court with a formal request, asking for an extension of Sanjay Kumar Mishra’s tenure as part of his role. Specifically, they were seeking an extension that would enable him to continue serving until October 15.
The Supreme Court had ruled that the two prior extensions of Mishra’s tenure, which had taken him beyond the date of September 8, 2021, were deemed to be “not valid in law.” This judicial declaration carried substantial legal weight, indicating that the extensions granted to Mishra in the past had not adhered to legal norms or regulations.
