Govt. Notifies Rules to amend the Debts Recovery Appellate Tribunal [Read Notification]

The Government notified the  Rules to amend the Debts Recovery Appellate Tribunal.

The Government notified r the Debts Recovery Appellate Tribunal, Allahabad and Debts Recovery Tribunals at Allahabad, Ranchi, Jabalpur, Patna, Lucknow and Dehradun Recruitment (Amendment) Rules, 2021;  Debts Recovery Appellate Tribunal, Chennai and Debts Recovery Tribunals at Ernakulam, Chennai, Madurai, Coimbatore and Bangalore Recruitment (Amendment) Rules, 2021;  Debts Recovery Appellate Tribunal, Delhi and Debts Recovery Tribunals at Chandigarh, Delhi and Jaipur Recruitment (Amendment) Rules, 2021; the Debts Recovery Appellate Tribunal, Kolkata and Debts Recovery Tribunals at Hyderabad, Guwahati, Kolkata, Visakhapatnam, Siliguri and Cuttack Recruitment (Amendment) Rules, 2021; Debts Recovery Appellate Tribunal, Mumbai and Debts Recovery Tribunals at Aurangabad, Mumbai, Ahmedabad, Pune and Nagpur Recruitment (Amendment) Rules, 2021.

The notification reads in the third Schedule, against serial number 3,in the entries under Column (3), for the words “Central Government”, the word “President” shall be substituted.

In the Fourth Schedule the for Debts Recovery Tribunal the Presiding Officer, Debts Recovery Tribunal will be the appellate Authority for the Disciplinary Authority competent to impose penalties in accordance with rule 11 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 namely Registrar, Debts Recovery Tribunal; Chairperson, Debts Recovery Appellate Tribunal will be the appellate authority for the Presiding Officer, Debts Recovery Tribunal; and President shall be the appellate authority for the Chairperson, Debts Recovery Appellate Tribunal in respect of minor penalties and the Central Government in respect of major penalties.

In the Fourth Schedule the for Debts Recovery Appellate Tribunal the Chairperson, Debts Recovery Appellate Tribunal will be the appellate authority for Registrar, Debts Recovery Appellate Tribunal; and President shall be the appellate authority for the Chairperson, Debts Recovery Appellate Tribunal in case of minor penalties and Central Government in respect of major penalties.
