GST Evasion: CGST Delhi arrests a Person with Non-Bailable Charges for availing fraudulent ITC

The Central GST Delhi North Commissionerate has arrested the two persons with Non-Bailable charges for availing fraudulent Input Tax Credit (ITC).

The CGST has unravelled an operation involving use of fraudulent Input Tax Credit to claim refunds under Inverted Tax Structure. Sh. Vikas Goyal, owner of M/s Gupta Plastics and active manager in M/s Gupta Industries procured invoice-less goods without payment of GST.

He also obtained fraudulent ITC from many non-existing firms. The fraudulently ITC availed using good-less invoices is to the tune of Rs 6.15 crores Further, he has filed refund claims to the tune of Rs 4 crores under inverted duty structure category with Central and State GST authorities on the basis of fraudulently availed ITC.

Sh. Vikram Goyal, appears to have committed offence under the provisions of Section 132 (1) (c) and Section 132(1)(e) of Central Goods and Services Tax Act, 2017 which is a cognizable and non-bailable charges, punishable under Section 132(5) of CGST Act,2017.

Accordingly, the said person was arrested on 15.02.2020 under Section 69(1) of CGST Act, 2017, and remanded to judicial custody up to 18th February 2020 by the Chief Metropolitan Magistrate in Patiala Court today, on 15th February 2020.
