The 52nd Goods and Services Tax (GST) Council Meeting, presided by Union Finance Minister, held on October 7th, 2023. The minister was accompanied by Revenue Secretary Sanjay Malhotra, State Finance Minister Pankaj Chaudhary, CBIC chairman ..etc.

The GST Council has announced two major decisions that will reshape the future of GSTAT. The first decision pertains to the maximum tenure age for the President of GSTAT, and the second involves inviting advocates to serve as Judicial Members in the tribunal.

The council has announced an increase in the maximum age limit for the President, from 67 years to 70 years, and for the members, from 65 years to 67 years. Additionally, advocates with at least a decade of experience and a minimum age of 50 years are now eligible for appointment as ‘Judicial Member’ not ‘Technical Member’.

Advocates, with their extensive legal knowledge and litigation experience, are well-equipped to handle complex tax disputes. Their inclusion in GSTAT is expected to enhance the quality of deliberations and provide a more balanced perspective during the adjudication process. It also opens up new opportunities for legal professionals to contribute to the country’s tax jurisprudence.
