ICAI removes another CA for Professional Misconduct [Read Notification]

The Institute of Chartered Accountants of India (ICAI) notified the removal of a Chartered Accountant after finding him guilty of professional misconduct. The CA was removed from the rolls of the Institute for six months. A fine of Rupees five Thousand was also imposed on him.
This is in terms of the provisions of Section 21B (3) of the Chartered Accountants Act, 1949 [as amended by the Chartered Accountants (Amendment) Act, 2006] read with Rules 18(17) and 19(1) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007.
Earlier, the appellate authority has, vide its order dated 8th January 2018, confirmed the findings of the disciplinary committee.
A notification issued by the Institute on Friday said that “CA. Harish Kapoor (Membership No. 082533), M/s. Bhasin Raghavan & Co., Chartered Accountants, F-48, Bhagat Singh Market, New Delhi 110 001, has been held guilty of Professional Misconduct falling within the meaning of Clause (7) of Part I of Second Schedule to the aforesaid Act by the Disciplinary Committee which ordered for removal of the name of aforesaid CA. Harish Kapoor (Membership No. 082533) from the Register of Members for a period of six (6) months and also imposed a fine of Rs. 50,000/- (Rupees Fifty Thousand only).”
“In pursuance thereof and in the exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified that the name of said CA. Harish Kapoor (Membership No. 082533), shall stand removed from the Register of Members for a period of six (6) months with effect from 23rd February 2018,” it said.
