ICSI approves to authorize the Company Secretary in Practice for appointment as Authorized Collection Centre for E-Stamping

The Institute of Company Secretaries of India ( ICSI ) has approved to authorize the Company Secretary in Practice for appointment as authorized collection center of e-stamping.

The Gujarat Government vide notification dt.2310812019 has amended Rulel3 of the Gujarat Stamp (Payment of Duty by means of E-Stamping) Rules, 2014. According to ICSI this amendment apart from Scheduled Banks, Financial Institutions and Units Controlled by Central and State Government, Post Offices in addition Licensed Stamp Vendor, Chartered Accountant, Company Secretary, C & F Agent at Port, Common Service Centre Working under e-Governance Plan, RBI Registered Non-Banking Financial Company and Licensed Notary or in prior consultation of the State Government, any Person/Agency who wishes to be appointed as ACC can be appointed by Appointing Authorised Officer/ Superintendent of Stamps under Rule-12.

The Council noted that the appointment of Company Secretary in Practice as authorized Collection Centre for E-Stamping is not covered under the services prescribed under Section2(2) of the Company Secretaries Act, 1980 and also in the resolution passed by the Council under section 2(2)(f) of the Company Secretaries Act, 1980.

The Council after detailed deliberations felt that this will add one more area of service to be rendered by Company Secretary in Practice and accorded its approval to authorize the Company Secretary in Practice for appointment as Authorized Collection Centre for e-stamping in the State of Gujarat.

The Council has further accorded its approval to authorize the Company Secretary in Practice for appointment as authorized Collection Centre for e-stamping in all the other states, on receipt of the recognition from the respective states.
