Important GST Meeting held at Haryana on VAT Refund, C Form Issuance & More [Read Circular]

Important - GST - Meeting - VAT - Refund - C - Form - Issuance - TAXSCAN

An interactive meeting was held at Apparel House, Gurugram in which the Chief Minister of Haryana, Manohar Lal and the Deputy Chief Minister Dushyant Chautala along with several other government officials met with Haryana Tax Bar Associations and discussed various Goods and Services Tax (GST) related matters.

The key points of discussion are as given below:–

VAT Refunds

The issue of pending VAT refunds was raised by the Bar Association. It was decided that the matter of pending VAT refunds would be taken up in the subsequent monthly review meetings of the district and efforts would be to issue the refunds to the dealer at the earliest.

It was also announced that VAT refunds should be taken in priority and the FIFO (First in First Out) method should be used for disposing of these refunds.

C Form

The tax bar association raised the issue of delay in issuance of C Forms by the Department. It was announced that prescribed authority should issue C Forms under the relevant provisions of the CST Act up to 31st March 2023 and this should be publicized.

It was also directed that the pendency of rectification on account of statutory forms should also be disposed of by 31 March 2023.

GST Registration

Members of the Bar Association raised concern that GST registration is not issued timely and the Government should strive to give registration at the earliest.

The Chief Minister emphasized that physical verification of the taxpayers before registration is important to ensure authenticity of taxpayers.

The CM further requested that advocates should come forward and encourage small taxpayers to get registered under GST. He also announced that top three advocates who get maximum GST registrations would be awarded with a certificate of recognition

Pendency in GST / VAT Appeal

The tax bar associations raised the issue of high pendency of appeals both in VAT/ GST specially in Gurugram area.

The Chief Minister announced that in addition to posting of Joint Commissioner (Appeal) at Rohtak, Ambala and Faridabad, 2 new posts of Joint Commissioner (Appeal) would be established in Gurugram and Hisar from 1st January 2023.

It was further announced that the Joint Commissioner (Appeals) shall start hearing VAT appeals through Video Conference facility from 31st March 2023.

Grievance Redressal

The tax bar association raised their concern about lack of mechanism/avenues for addressing their concerns/grievances.

The association informed that earlier there used to be a mechanism under the umbrella of Aamne Samne where for Tax Bars regularly interacted with officers.

Tax Bar associations requested that a similar mechanism shall be continued in GST. The proposal was accepted and the Chief Minister announced that a platform of GST Aamne Samne or Joint Working Group would be established to meet and discuss their concerns and grievances. These meetings will be held under the Chairmanship of the respective Joint Commissioner (Range)

GST Tribunal

The tax bar association raised their concern of a non-operational GST tribunal. The associations were informed that the matter of the GST tribunal is under consideration by the GST Council. The Chief Minister announced that the Benches of the GST Tribunal will be set up in Gurugram and Hisar in the State..

Other issues

Other discussions carried out in the meeting include long detention of vehicles by Enforcement Officers, blocking of Input Tax Credit (ITC) for more than one year and issuance of Summons under Section 70 for routine matters.

The provision of Canteen, Library and Lounge facilities for members of the tax bar was also brought up for discussion.
