Income Tax Dept recovers Dues since NFAC does not List Appeal since 18 Months: Delhi HC directs Expedition of Hearing [Read Order]

A division bench of the Delhi High Court comprising Justice Manmohan and Justice Manmeet Pritam Singh Arora, has recently directed the National Faceless Appeal Centre (NFAC) to expedite the hearing considering the fact that the appeal is not yet listed even after two and half years after its filing and the income tax department has recovered the dues from the assessee.

The assessee, Priti Nanda filed an appeal against the order of the Assessing Officer. Whilst the appeal was pending, the Ministry of Finance introduced the ‘Faceless Appeal Scheme 2020’. The Petitioner argued that the appeal stands transferred to National Faceless Appeal Centre and it has been more than two and half years since the filing of the appeal, but the appeal has not been listed. The petitioner submitted that the Petitioner had also emailed the Respondents seeking an early fixation of appeal on 19th May, 2022, but to no avail.

“Accordingly, the present writ petition along with pending application is disposed of with a direction to the Petitioner to file an early hearing application before the Appellate Authority i.e. National Faceless Appeal Centre. In the event, such an application is filed within two weeks, the Respondent No.2 is directed to decide the same in accordance with law within four weeks thereafter.”
