The Delhi Chief Metropolitan Magistrate has recently rejected the bail plea of the arrested accused, Shilpa Chawla in a fake Goods and Services Tax (GST) Input Tax Credit (ITC) claim matter under investigation.
On behalf of the applicant-accused, it was submitted by J K Mittal that the applicant/accused is a 50 years old homemaker and is resident of Kavi Nagar, Ghaziabad, UP. That applicant/accused is also a sleeping partner in Hindustan Paper Machinery Industries and looks after the affairs of the said firm exclusively.
That applicant/accused has a son about 15 years old who is studying in 9th class and his exams are starting from 09.02.2023 and that applicant has to take care of his son. Besides that, the applicant also has her mother-in-law who is about 70 years old and the applicant has to look after her who also has age related problems, the applicant counsel submitted.
The counsel for the accused also submitted that, the applicant undertakes to abide by all the terms and conditions which may be imposed upon while granting bail.
The prosecution, on the other hand, prayed that considering the grounds, gravity and seriousness of the offenses, the present application may be dismissed. It was also stated that summons/notices were issued prior to arrest and after seeking approval of Competent Authority, the accused/applicant was arrested as per rules.
Observing the lack of document on record to prove the exams of the son, the prima facie view that the accused in not a sleeping partner and the seriousness of the offences alleged to have been committed by the accused, the Chief Metropolitan Magistrate of Delhi District Snigdha Sarvaria, Patiala House Court, rejected the bail plea of the accused, Shipra Chawla.
