A Single Bench of the Kerala High Court, granting relief to a petitioner in a Motor Vehicle Tax Dispute, allowed the pending motor vehicle tax liability to be discharged in six equal monthly installments.

Represented by advocate Saju J. Vallyara, the petitioner sought issuance of a writ of mandamus or any other appropriate writ, direction, or order directing the respondent, the Joint Regional Transport Officer (Taxation Officer), Perinthalmanna, Malappuram District, to accept the arrears of motor vehicles tax in eight monthly installments and grant of any other reliefs deemed fit and proper by the Court in the circumstances of the case.

During the hearing, the petitioner's counsel argued for the acceptance of the tax arrears in installments, highlighting the petitioner's willingness to discharge the tax liability through this arrangement.

The Government Pleader, Jasmin M M, did not object significantly to the prayer for installments to clear the tax liability, acknowledging that the outstanding tax amount against the petitioner was Rs.1,13,731/-.

The petitioner was directed to discharge the tax liability on the goods carriage vehicle in six equal monthly installments by the Single Bench of Justice Dinesh Kumar Singh.

The Kerala High Court further directed that, the first installment is to be paid on or before 16th April 2024, with the remaining five installments due on the 16th day of each succeeding month.

The authorities were granted the liberty to proceed against the petitioner under the Revenue Recovery Act in case of default in remitting any of the installments.
