Kerala HC Directs Income Tax Department to Expedite Stay Petition on Assessment Order; Further Proceedings Put on Hold [Read Order]

The Kerala High Court has directed the Income Tax Department to consider a stay petition filed by Sea Pride Fuels against an assessment order. The writ petition filed by the company challenged the assessment order issued by the department.

The petitioner, represented by K.N Sreekumaran, emphasised their right to a fair hearing on their appeal against the order along with a stay petition filed with the department. The petitioner also requested to pause any further proceedings based on the assessment. The appeal was pending before the Commissioner of Income Tax (Appeals) of the National Faceless Appeal Centre.

The bench of Justice Viju Abraham acknowledged the submission of the department that the stay petition would be addressed without delay.

The court directed the department to ensure a fair hearing for the petitioner before reaching a decision on the stay petition and mandated that it be completed within two months from the date of receipt of a copy of the judgement.

As per the court order, all further proceedings based on the original assessment order will be put on hold until the department issues a decision on the stay petition. The court disposed of the writ petition.
