Letters of Forign Govt Depts & Foreign Embassies are to be deemed as ‘Proof of Address’ for Foreign Nationals: Govt Amends PMLA Rules [Read Notification]

The Central Government, on Tuesday, amended the Prevention of Money-laundering (Maintenance of Records) Rules, wherein it was stated that the documents issued by the Government departments of foreign jurisdictions and letter issued by the Foreign Embassy or Mission in India shall be treated as proof of address for foreign nationals if the official identity card presented by them does not contain the address details.

Recently, the Government has made it mandatory for banks and financial institutions to check the original identification documents of individuals dealing in cash above the prescribed threshold.

Officially valid document, for the purpose of the Prevention of Money Laundering Act (PMLA) would mean the passport, the driving license, the Permanent Account Number (PAN) Card, the Voter’s Identity Card issued by 4 [Election Commission of India, job card issued by NREGA duly signed by an officer of the State Government, the letter issued by the Unique Identification Authority of India containing details of name, address and Aadhaar number or any other document as notified by the Central Government in consultation with the Regulator.

As per the amended rules, “in case the officially valid document presented by a foreign national does not contain the details of address, in such case the documents issued by the Government departments of foreign jurisdictions and letter issued by the Foreign Embassy or Mission in India shall be accepted as proof of address”.
