MCA appoints Retd. Judge Talwant Singh as Chairperson of ICAI, ICSI, ICMAI Appellate Authority [Read Notification]

The Ministry of Corporate Affairs ( MCA ) has appointed a new Chairperson of the Appellate Authority of the Professional Institutes. The professional institutes include ICAI, ICSI, ICMAI.

The ministry has appointed Justice Talwant Singh, the retired judge of Delhi High Court. Thus, he replaced Justice Suresh Kumar Gupta, Judge (Retd.), High Court of Allahabad, who was appointed as the chairperson in April 2024.

The other members appointed in April 2024 were Rakesh Mohan, Sandip Garg  and Amit Anand Apte. There are no changes in these names, however, the Chairperson has been changed.

The provision of Section 22A of the Chartered Accountants Act, 1949, Cost and Works Accountants Act, 1959 and Company Secretaries Act, 1980 empowers the central government to appoint the chairperson for the professional institutes.

Section 22A of the Chartered Accountants Act mandates the Central Government to establish an Appellate Authority through a notification. This authority will consist of the following members:

(a) a Chairperson who is or has been a judge of a High Court,

(b) two members who have served at least one full term on the Council and are not current members, and

(c) two members nominated by the Central Government with expertise in law, economics, business, finance, or accountancy. All members, including the Chairperson, will serve on a part-time basis.

Justice Talwant Singh, the new Chairperson, has a rich background in law and judiciary. He holds a Commerce degree from SGTB Khalsa College, Delhi University, a Master’s in Commerce from Meerut University, an Advanced Diploma in Management from IGNOU, and an LL.B. from Meerut University (1986). He began his legal career in 1986, practising in Corporate, Family, Civil, and Criminal Law at the Delhi Bar until 2000.

Justice Singh has been a strong advocate for the use of Information and Communication Technology (ICT) in courts, contributing significantly to the computerization of Delhi District Courts. He served on the Supreme Court’s E-Committee, responsible for digitizing over 14,000 courts nationwide, and played a key role in developing India’s first paperless E-Court.
