On November 11, 2024, the Ministry of Corporate Affairs ( MCA ) published updated guidelines for recruiting Company Prosecutors. These new rules apply to positions classified under Group ‘B’, Gazetted posts.
Name of Post: Company Prosecutor.
Number of Posts: There are 120 positions available though this number may change depending on workload.
Classification: The role falls under General Central Service, Group ‘B’, Gazetted, Ministerial.

Level in Pay Matrix: The position is categorized at Level-7 in the pay matrix, with a salary range of Rs. 44,900 to Rs. 1,42,400.
Selection Post or Non-selection Post: This is classified as a non-selection post.
Age Limit for Direct Recruits: The maximum age for direct recruits is 30 years, with an age relaxation of up to 5 years for government servants.
Educational and Other Qualifications for Direct Recruits: Candidates must hold a bachelor’s degree in law or an integrated degree in law from a recognized university.
Whether Age and Educational Qualifications Apply to Promotees: These requirements do not apply to promotees.

Period of Probation: The probation period is two years which includes mandatory induction training of at least two weeks.
Method of Recruitment: Recruitment is primarily through direct hiring though deputation may be considered if a position is vacant for over a year or more due to absence for reasons such as illness or leave.
In Case of Promotion, Grades from which Promotion to be Made: Promotion is not applicable for this role.
Departmental Promotion Committee Composition: The committee consists of the following members:
- Joint Secretary, Ministry of Corporate Affairs (Chairman)
- Director or Deputy Secretary (Member)
- Under Secretary (Member)

Consultation with UPSC: Consultation with the Union Public Service Commission (UPSC) is required for the direct recruitment process.
Disqualification Criteria: Candidates are disqualified if they are married to someone who has a living spouse or if they have a living spouse and have married someone else. However, the Central Government may allow exceptions if the marriage is legally permitted under applicable personal law and valid reasons exist.
Authority to Relax Rules: The Central Government can relax some requirements for certain groups if necessary. Such relaxations must be justified in writing and done in consultation with the Union Public Service Commission (UPSC).

Reservations and Special Concessions: These rules uphold any reservations, age relaxations, or other concessions granted to Scheduled Castes, Scheduled Tribes, Other Backward Classes, ex-servicemen, and other special categories as directed by the Central Government.
