MCA notifies NCLT (Recruitment, Salary and other terms and conditions of services) Rules, 2020 [Read Notification]

The Ministry of Corporate Affairs (MCA) has notified National Company Law Tribunal ( NCLT (Recruitment, Salary and other terms and conditions of services) Rules, 2020.

These rules pertain to a notification which consists of 17 rules and 2 schedules.

In a notification published in the official gazette on January 21, 2020, consists of 14 rules which pertain to:

  1. Definition of terms used very commonly such as the meaning of Act, Appointing Authority, Tribunal, President, schedule, etc.
  2. These rules will be applied on all the posts which are specifically mentioned in the Schedule I of these rules.
  3. Initial constitution wherein all the posts specified in Column I of Schedule I, further that person who is holding the post specified in Column I of Schedule I become an employee of the tribunal on the regular basis on or from the dissolution of the company that person will be regarded as if he has been duly appointed by under provisions of these rules.
  4. The number of posts, classification, and the level of pay matrix will be in accordance with the Schedule I of these rules.
  5. The notification also consists appointment of the officers and also the appointment of the employees in the tribunal. Further, the appointment shall be made by the Appointing Authority and the pay matrix will be in accordance with the 7th Pay Commission with the approval of the central government.
  6. The rules also elaborate on the procedure for appointment by direct recruitment.
  7. The tribunal is empowered to ask for the application for different posts through the way of publishing invariably in employment as an advertisement.
  8. These rules also elaborate on the absorption of employees on the appointment on deputation.
  9. It further clarifies the conditions of services, accommodation, any disciplinary proceedings, disqualification, the power to relax and savings.
