Moneygram - CESTAT - Taxscan

In a recent order, the Customs, Excise & Service Tax Appellate Tribunal (CESTAT), Mumbai held that Moneygram India Private Limited is entitled to avail CENVAT credit on input services viz. Event Management services.

The Appellant Moneygram filed an appeal against the order passed by the Commissioner of CGST & CX, Mumbai. In the impugned order, the learned Commissioner (Appeals) has allowed a cash refund of accumulated CENVAT Credit on various input services except for event management service, which in the opinion of learned Commissioner Appeals, not admissible, being having no nexus with the output service.

The Council on behalf of Moneygram submitted that events are organized by the company for promoting their brand value and thus having direct nexus with the output service provided by the company.

Relying on the judgment in the case of Honda Motorcycle & Scooter (I) Pvt. Ltd Vs CCE Delhi-III, the Judicial Member Dr. D M Misra did not find any merit in the impugned order hence set aside.
