In a significant development, the Union Government has officially notified the commencement date for the enforcement of three groundbreaking criminal laws - Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Adhiniyam. According to notifications issued by the Ministry of Home Affairs ( MHA ) today, these laws are set to come into effect on July 1, 2024.

However, the implementation of Sub Section (2) of Section 106 of Bharatiya Nyaya Sanhita, a provision specifically addressing 'causing death of a person by rash and negligent driving of a vehicle,' has been temporarily halted by the Centre. This decision comes in response to widespread protests from truckers opposing this particular provision.

The MHA notification stated, "In exercise of the powers conferred by sub-section (2) of section 1 of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023), the Central Government hereby appoints the 1st day of July, 2024, as the date on which the provisions of the said Sanhita, except the provision of sub-section (2) of section 106, shall come into force."

These new laws, designed to replace the existing Indian Penal Code, Code of Criminal Procedure, and Indian Evidence Act, were unanimously passed by the Parliament on December 21, 2023. The President provided assent on December 25, 2023. It's noteworthy that the statutes explicitly mentioned their effective date would be determined by the Union Government.

As the nation awaits the implementation of these transformative laws, the temporary hold on the provision related to rash and negligent driving reflects the government's responsiveness to the concerns raised by the trucking community.
