Petition Seeking to Quash House Tax Bill: Allahabad HC directs to File Representation before UPMC Zonal Officer [Read Order]

In a recent ruling, the Allahabad High Court, in a petition seeking to quash the House Tax Bill directed to file a representation before the UPMC ( Uttar Pradesh Municipal Corporation ) Zonal officer.

The petitioner, Lakhan Lal  filed a writ petition seeking reliefs including to Issue a writ order or direction in the nature of certiorari quashing the House Tax Bill for the Financial Year 2023-24  in the interest of justice. Also sought relief to consider and decide the Representation/Objection.

The counsel of the petitioner submitted that petitioner has already moved a representation in this regard under Section 213 of U.P. Municipal Corporation Adhiniyam, 1959. He further submitted that grievance of petitioner would be sufficiently met in case representation of petitioner for the said purposes is considered and decided in a time bound manner by respondent no.4. On the contrary, the respondents did not have any objection.

The High Court, with Justices Brij Raj Singh and Vivek Chaudhary, allowed the petitioner to submit a detailed representation to respondent no.4, Zonal Officer, Zone II, Municipal Corporation, Aishbagh, Lucknow, including all grievances, along with a copy of the writ petition, annexures, and supporting documents, within one week. Additionally, a certified copy of the court order should accompany the submission.

The High Court directed the respondents to consider and decide the representation after hearing all parties concerned by a reasoned and speaking order within a period of four weeks from the date, a certified copy of this order along with representation is placed before him. It was clarified that any demand against the petitioner shall be subject to final order passed by respondent no.4.
