The Kerala High Court directed to extend validity period if entitled in the plea to direct Consulate General of India direction to renew Passport for minimum period of 5 years.

The petitioner’s, Sreelekshmi Jayanthi, passport was retained by the Customs authority and was later released pursuant to the judgment of this Court dated 28.06.2019 in WP(C) No.17468 of 2019. She was proceeded against in proceedings F.No.S14/44/2019-AIR Cus. dated 16.06.2019 and the appeal in respect of the said proceedings is pending before the Customs, Excise and Service Tax Appellate Tribunal. Since the period of validity of the passport of the petitioner was to expire on 15.08.2024, she filed WP(C) No.24684 of 2023 seeking direction for renewal of the passport.

The High Court directed the Consulate General of India at Dubai to consider the request of the petitioner for renewal of Passport in accordance with law within a period of two weeks from the date of receipt of a certified copy of the judgment. Pursuant to judgment, the Passport of the petitioner was renewed with a validity period of one year. The petitioner has filed this writ petition for a direction to the 3rd respondent to renew the Passport for a minimum period of 5 years.

The DSGI submitted that the petitioner was issued with a Passport of validity period of one year as judgment does not refer to any validity period.

A Single Bench of Justice Dinesh Kumar Singh observed that “In judgment this Court had only directed the 3rd respondent to consider the request of the petitioner for renewal of Passport and did not refer to any validity period judgment will not stand in the way of the 3rd respondent from issuing a full validity Passport, if the petitioner is otherwise entitled for the same.”
