Professional Misconduct by CAs: ICAI removes 6 Chartered Accountants from Member Register

The Institute of Chartered Accountants of India ( ICAI ) has removed the name of 6 Chartered Accountants from the register of members. The Disciplinary Committee of ICAI found the Chartered Accountants guilty of professional misconduct, according to sources.

Names of the following Members have been removed from the Register of ICAI:

The Disciplinary Committee has held CA. Janakkumar Shantilal Soni, guilty of Professional Misconduct falling within the meaning of Clause (7) of Part I of Second Schedule to the aforesaid Act and consequently after affording an opportunity of being heard in terms of Rule 19(1) of the aforesaid Rules, ordered for removal of name of the CA from the Register of Members for a period of 03(Three) years.

In pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations 1988, that the name of said CA shall stand removed from the Register of Members for a period of 03(Three) years with effect from 24th March, 2023.

The Disciplinary Committee has held CA. Som Monoranjan, guilty of Professional Misconduct falling within the meaning of Clause (1) of Part II of Second Schedule to the aforesaid Act and consequently after affording an opportunity of being heard in terms of Rule 19(1) of the aforesaid Rules, imposed a fine of Rs. 4,00,000/-(Rupees Four Lakhs) only to be paid within 90 days and in case of default in payment of fine within stipulated time, his name be removed from the Register of Members for a period of 01(One) month.

Since the Respondent had failed to pay the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations 1988, that the name of said CA shall stand removed for a period of 01(One) month with effect from 24th March, 2023.

The Disciplinary Committee has further held CA Samar Jit Mitra guilty of Professional Misconduct falling within the meaning of Clause (1) of Part II of Second Schedule to the aforesaid Act and consequently after affording an opportunity of being heard in terms of Rule 19(1) of the aforesaid Rules, imposed a fine of Rs. 2,00,000/-(Rupees Two Lakhs) only to be paid within 90 days and in case of default in payment of fine within stipulated time, his name be removed from the Register of Members for a period of 01(One) month.

Since the Respondent has failed to pay the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations 1988, that the name of said CA shall stand removed for a period of 01(One) month with effect from 24th March, 2023.

The Disciplinary Committee has held CA Tushar Kanti Jana guilty of Professional Misconduct falling within the meaning of Clause (1) of Part II of Second Schedule to the aforesaid Act and consequently after affording an opportunity of being heard in terms of Rule 19(1) of the aforesaid Rules, imposed a fine of Rs. 5,00,000/-(Rupees Five Lakhs) only to be paid within 90 days and in case of default in payment of fine within stipulated time, his name be removed from the Register of Members for a period of 01(One) month.

Since the Respondent has failed to pay the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations 1988, that the name of said CA shall stand removed for a period of 01(One) month with effect from 24th March, 2023.

The Disciplinary Committee has held CA Sandhya Jayesh Vasandani guilty of Professional Misconduct falling within the meaning of Items (5) and (7) of Part I of Second Schedule to the aforesaid Act and consequently after affording an opportunity of being heard in terms of Rule 19(1) of the aforesaid Rules, ordered for removal of name of the CA from the Register of Members for a period of 01(One) year and also imposed a fine of Rs. 1,00,000/-(Rupees One Lakh) only.

In pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations 1988, that the name of said CA shall stand removed from the Register of Members for a period of 01(One) year with effect from 24th March, 2023.

The DC of the Institute of Chartered Accountants of India has further held CA Sidharth Sahni guilty of ‘Other Misconduct’ falling within the meaning of Item (2) of Part IV of the First Schedule read with Section 22 of the aforesaid Act and consequently after affording an opportunity of being heard in terms of Rule 15(1) of the aforesaid Rules ordered for removal of the name of the  CA from the Register of Members for a period of 15(Fifteen) days and also imposed a fine of Rs. 1,00,000/- (Rupees One Lakh) only.

In pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations, 1988 that the name of said CA shall stand removed from the Register of Members for a period of 15(Fifteen) days with effect from 24th March, 2023.
