Professional Misconduct: ICAI Notifies Removal of 11 Chartered Accountants Including Ex-Statutory Auditor of Amrapali Group

The Institute of Chartered Accountants of India (ICAI) has notified the removal of 11 chartered accountants from its register after finding guilty of Professional Misconduct falling within the meaning of Items (2),(7) and (8) of Part I and Item (1) of Part II of the Second Schedule to the of the Chartered Accountants Act, 1949.

The chartered accountants so removed from the roll includes CA Anil Mittal who has been recently removed by the ICAI along with a fine of Rs. 5 lakh following the Amrapali Group housing scam. Relying on the Supreme Court observations against the Chartered Accountant, the disciplinary committee observed that the CA had failed to act independently while conducting audit of the Amrapali Group of Companies.

The ICAI notification issued on Friday stated that “the Disciplinary Committee has held CA. Anil Mittal guilty of Professional and Other Misconduct falling within the meaning of Items (5),(6),(7) and (8) of Part I of Second Schedule and Item (2) of Part IV of the First Schedule read with Section 22 of the aforesaid Act and consequently ordered for PERMANENT removal of name of CA. Anil Mittal (Membership No. 088204) from the Register of Members and also imposed a fine of Rs. 5,00,000/- (Rupees Five Lakhs only). In pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of said CA. Anil Mittal (Membership No. 088204), shall stand removed PERMANENTLY from the Register of Members with effect from 16th December, 2022.”

The names of the other chartered accountants are Amit Bhattacharjee, CA Bhavya Garg, CA. Nisith Kumar Sen, CA. Partha Pratim Mukhopadhyay, CA. Praveen Kumar Aggarwal, CA. Rajender Kumar, CA. Subrata De, CA. Swapan Acharjee, CA. T S Giri and CA Sardar Madhusudan.
